These Terms of Service govern your access to and use of Irregular Republic, including all purchases made through irregularrepublic.com. Throughout these Terms, “we,” “us,” and “our” refer to Irregular Republic.
By visiting our website, creating an account, submitting an order, or purchasing a product, you agree to these Terms of Service, our Privacy Policy, Shipping Policy, and Refund, Return, and Cancellation Policy.
Shopify allows merchants to publish custom terms, refund policies, privacy policies, and shipping policies through the store administration. Shopify also recommends having store policies reviewed for the laws applicable to the merchant’s business.
1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to place an order through our store.
By submitting an order, you represent that:
- You are legally able to enter into a binding agreement.
- The information you provide is complete and accurate.
- You are authorized to use the payment method submitted.
- You will not use our products or website for an unlawful purpose.
2. Online Store
Our store is hosted through Shopify, which provides the ecommerce platform that allows us to display and sell our products.
Your purchase agreement is with Irregular Republic, not Shopify. Questions about products, orders, shipping, defects, cancellations, or customer service should be directed to us at admin@irregularrepublic.com.
3. Products Are Custom-Made
All products are custom-made, printed, embroidered, engraved, assembled, or otherwise produced specifically after the customer submits an order.
Because production begins based on the customer’s selections, our products cannot ordinarily be restocked or resold. Customers are responsible for carefully reviewing all product details before checkout, including:
- Product type
- Size
- Color
- Quantity
- Design
- Personalization
- Spelling
- Shipping address
- Billing information
Submitting an order authorizes us and our production partners to begin manufacturing the selected products.
4. Product Images and Descriptions
We make reasonable efforts to display product colors, designs, dimensions, and descriptions accurately. However, actual products may differ slightly from images displayed on a computer, tablet, or mobile device.
Differences may result from:
- Screen brightness and color settings
- Fabric or material variations
- Printing, embroidery, or manufacturing processes
- Product placement or alignment tolerances
- Differences between product sizes
- Manufacturer updates
- Normal production variations
Minor differences that do not materially affect the design or usability of the product are not considered defects.
Sizing charts are provided for guidance. Customers are responsible for selecting the correct size before completing an order.
5. Prices
All prices are shown in United States dollars, unless otherwise stated.
We may change product prices, shipping rates, promotions, or product availability at any time without prior notice. Price changes do not affect orders that have already been accepted and paid.
Applicable taxes, shipping charges, duties, customs fees, or other charges may be added during checkout.
6. Orders
Submitting an order does not guarantee acceptance. We reserve the right to accept, reject, limit, or cancel an order for reasons including:
- Suspected fraud
- Payment authorization failure
- Pricing or listing errors
- Product unavailability
- Production limitations
- Violation of these Terms
- Illegal, infringing, threatening, or inappropriate customization requests
- Orders intended for unauthorized resale
If we cancel an order before production because we cannot fulfill it, we will refund the amount paid for the cancelled portion.
We may limit quantities purchased by one person, household, account, payment method, billing address, or shipping address.
7. Payment
Payment is due at checkout. By submitting payment information, you authorize us and our payment processors to charge the full amount shown at checkout.
You agree to provide accurate and current billing information. We are not responsible for delays caused by:
- Declined payments
- Incorrect billing details
- Fraud screening
- Payment disputes
- Additional verification requirements
Title to purchased products does not pass to the customer until payment has been successfully completed.
8. Order Changes and Cancellations
Orders may enter production shortly after checkout.
Once an order has entered production, it cannot be:
- Changed
- Cancelled
- Returned
- Exchanged
- Refunded
Requests to correct an order must be sent immediately to admin@irregularrepublic.com. We will attempt to make the requested correction, but we cannot guarantee that a change or cancellation will be possible.
A request is not approved unless we confirm approval in writing.
9. All Sales Are Final
Because all products are custom-made and produced specifically for each customer, all sales are final.
We do not provide refunds, returns, exchanges, or store credit for:
- Ordering the wrong size
- Ordering the wrong color
- Ordering the wrong quantity
- Incorrect personalization submitted by the customer
- Change of mind
- Buyer’s remorse
- Duplicate orders submitted by the customer
- Minor printing or manufacturing variations
- Slight color differences
- Normal wear
- Failure to follow care instructions
- Incorrect or incomplete shipping information supplied by the customer
- Delays caused by carriers, weather, customs, or events outside our reasonable control
This provision is subject to any rights that cannot lawfully be excluded under applicable consumer-protection law.
10. Damaged, Defective, Misprinted, or Incorrect Products
We will review claims involving products that arrive:
- Materially damaged
- Defective
- Misprinted
- Incomplete
- Different from the product ordered
Claims must be submitted to admin@irregularrepublic.com within 7 calendar days after confirmed delivery.
The claim must include:
- Customer name
- Order number
- Description of the problem
- Clear photographs of the complete product
- Close photographs of the defect
- Photographs of the packaging and shipping label, when relevant
We may request additional evidence before approving a claim.
If we determine that the product was damaged, defective, misprinted, or incorrectly fulfilled, we may provide, at our discretion and as permitted by law:
- A replacement product
- A reprint
- A refund for the affected item
- Another reasonable remedy
We do not guarantee that the customer may choose the remedy. No replacement or refund will be issued until the claim has been reviewed and approved.
Products must not be worn, washed, altered, or further damaged before the claim is submitted, except when necessary to discover the defect.
11. Shipping and Delivery
Production and shipping estimates are estimates, not guaranteed delivery dates, unless we expressly state otherwise in writing.
Customers are responsible for providing a complete and accurate delivery address. We are not responsible for orders that are delayed, returned, lost, or misdelivered because the customer supplied an incorrect or incomplete address.
Additional production and shipping charges may apply if an order must be recreated or reshipped because of customer-provided address information.
Federal rules generally require online sellers to have a reasonable basis for advertised shipping times. When an order cannot be shipped within the promised period—or within 30 days when no period was stated—the seller generally must obtain the customer’s consent to the delay or provide a prompt refund for the unshipped merchandise. Our final-sale policy does not override those requirements.
12. Carrier Delays and Delivery Claims
Once an order has been transferred to the shipping carrier, delivery may be affected by circumstances outside our control, including:
- Weather
- Carrier congestion
- Labor disruptions
- Customs processing
- Incorrect address information
- Natural disasters
- Government restrictions
- Holiday volume
- Theft after delivery
A carrier delay by itself does not make a custom-made order eligible for a refund.
When tracking shows an order as delivered but the customer reports that it was not received, the customer should:
- Check the delivery location and surrounding property.
- Ask household members or neighbors.
- Contact the carrier.
- Notify us promptly.
We may require the completion of a carrier investigation, affidavit, police report, or other documentation before determining whether a replacement is appropriate.
13. Returned and Undeliverable Packages
Orders returned because of an incorrect address, refused delivery, failure to collect the package, or another customer-related delivery problem are not eligible for a refund.
We may offer reshipment after the customer pays:
- Additional shipping costs
- Carrier return fees
- Any reproduction costs, when the original item cannot be reshipped
14. Intellectual Property
All content associated with our store—including designs, artwork, photographs, graphics, logos, product names, written material, videos, branding, and website content—is owned by or licensed to Irregular Republic and is protected by applicable intellectual-property law.
Purchasing a product does not transfer ownership of the underlying artwork, design, trademark, copyright, or other intellectual property.
You may not, without written authorization:
- Copy our designs
- Reproduce our products for resale
- Download or redistribute our artwork
- Remove copyright or trademark notices
- Use our branding in a manner suggesting affiliation
- Create derivative commercial products
- Scrape or systematically collect website content
- Use our content to train a commercial artificial-intelligence system
15. Customer-Submitted Material
When you submit text, names, photographs, artwork, logos, or other material for customization, you represent that:
- You own the material or have permission to use it.
- The material does not violate another party’s copyright, trademark, privacy, publicity, or other rights.
- The requested product is lawful.
- The material is not fraudulent, defamatory, threatening, obscene, hateful, or otherwise prohibited.
You grant us and our production partners a limited license to reproduce, modify, format, transmit, and use the submitted material solely as necessary to process and fulfill your order.
You remain responsible for customer-submitted material and agree to indemnify us against claims arising from your unauthorized use of another person’s intellectual property or personal information.
We may refuse any customization request at our discretion.
16. Reviews, Feedback, and Submissions
When you voluntarily submit a review, photograph, testimonial, comment, suggestion, or other feedback, you grant us a nonexclusive, worldwide, royalty-free license to reproduce, publish, display, edit, and share that material for business and promotional purposes.
We will not intentionally represent edited feedback in a materially misleading manner.
You may request that we stop using a customer photograph or testimonial by contacting admin@irregularrepublic.com, although removal may not be possible from materials already printed, distributed, archived, or published by third parties.
17. Prohibited Uses
You may not use our website or services to:
- Violate any law or regulation
- Infringe intellectual-property rights
- Submit false or misleading information
- Transmit malware or harmful code
- Interfere with website security
- Attempt unauthorized access
- Scrape, crawl, or harvest data without permission
- Harass or threaten another person
- Commit fraud
- Place orders using stolen payment information
- Resell our products while falsely claiming authorization or affiliation
- Circumvent purchasing limits
- Abuse discounts, promotions, chargebacks, or refund procedures
We may suspend access, cancel orders, preserve records, and report suspected unlawful activity when appropriate.
18. Third-Party Services
Our store may use third-party providers for:
- Hosting
- Payments
- Printing
- Manufacturing
- Fulfillment
- Shipping
- Analytics
- Marketing
- Customer communications
Those providers may have separate terms and privacy practices. We are not responsible for third-party websites or services that are outside our control.
Links to third-party websites are provided for convenience and do not necessarily constitute endorsement.
19. Promotions and Discount Codes
Promotional offers are subject to any additional terms stated with the offer.
Unless expressly stated otherwise:
- Discounts cannot be combined.
- Discounts have no cash value.
- Discounts cannot be applied retroactively.
- Discounts may be limited by customer, product, order, or date.
- We may cancel a promotion affected by fraud, technical error, or misuse.
20. Disclaimer of Warranties
To the maximum extent permitted by law, the website and services are provided on an “as is” and “as available” basis.
We do not guarantee that:
- The website will always be uninterrupted or error-free.
- Product images will match every screen display exactly.
- All typographical or technical errors will be corrected immediately.
- Third-party services will remain continuously available.
- Shipping carriers will meet estimated delivery times.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
21. Limitation of Liability
To the maximum extent permitted by law, Irregular Republic, its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website, products, shipping, or use of the services.
To the extent liability cannot be excluded, our total liability relating to an order will not exceed the amount the customer paid for the specific product giving rise to the claim.
This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
22. Indemnification
You agree to defend, indemnify, and hold harmless Irregular Republic, its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, expenses, and reasonable legal fees arising from:
- Your violation of these Terms
- Your unlawful use of the website
- Customer-submitted content
- Your infringement of another person’s rights
- Fraudulent or unauthorized conduct associated with your account or order
23. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
By using our website, you acknowledge that information may be processed by Shopify, payment processors, production partners, shipping carriers, and other providers involved in operating the store and fulfilling orders.
24. Errors and Omissions
We may correct typographical errors, inaccurate descriptions, incorrect prices, availability errors, or omissions at any time.
When a material error affects an order, we may contact the customer to confirm whether the customer wishes to proceed under corrected terms or cancel the affected portion and receive a refund.
25. Force Majeure
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, epidemics, government action, carrier disruption, labor disputes, supply shortages, utility failures, or widespread technical outages.
This section does not eliminate any cancellation or refund rights required by applicable law.
26. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue in effect.
27. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
28. Entire Agreement
These Terms, together with the policies incorporated into them, constitute the entire agreement between the customer and Irregular Republic concerning use of the store and purchase of products.
29. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Any dispute that may lawfully be restricted to a particular forum will be brought in the state or federal courts serving Wake, North Carolina, and the parties consent to the jurisdiction of those courts.
Mandatory consumer-protection laws applicable to a customer’s location remain unaffected where they cannot legally be waived.
30. Changes to These Terms
We may revise these Terms periodically by publishing an updated version on the website.
Changes apply prospectively from the date posted. The Terms in effect when an order was submitted will generally govern that order unless a change is required by law.
Continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms.
